OBLIGATIONS OF MEMBERS OF THE ASSOCIATION

Bella Vista Drive properties are subject to the covenants set out in the Certificate of Title for Lot 3 DP194956 that transferred 3.6301 hectares that is defined in the Constitution of the Bella Vista Residents Association as Bella Vista Land.

This land is subdivided into Lots 1 to 40 that comprise the individual properties on which dwellings  may be built, each of which has an encumbrance registered against the title.  That encumbrance requires each purchaser of a lot at Bella Vista Drive to enter into a 
Deed of Covenant  recording  the Incumbent Member's obligations as a member of the Resident's Association.


The Memorandum of Encumbrance is registered against each Lot in favour of the Society, whereby each Owner is deemed to be a member of the Society, and thereby bound by the Constitution of the Society and will perform the obligations of a member of the Society as set out in this Constitution.

If you are considering buying one of the properties at Bella Vista your lawyer will advise you that you must first review the Constitution and agree to comply with its provisions and then execute the covenant form. These can be downloaded by clicking on the buttons below.

Bylaws

The bylaws of the Association are comprised in Schedule 2 of the rules governing the behaviour and conduct of members in relation to their neighbours. These bylaws are intended to establish the expectations that each owner at Bella Vista has in regard to the enjoyment of living in this community.

Purpose of Gulf Harbour Covenants
  1. ​​​Enhance and protect the amenity value of neighbourhoods which are situated next to or close to the Golf Course so as to ensure that views and outlook to the Golf Course landscaping and golfing activities are protected and enhanced.
  2. Encourage architectural compatibility (visual accord) within the Gulf Harbour development.
  3. Enhance visual integration and harmony between the Golf Course and the neighbouring properties.
  4. Co-ordinate an owners requirement for privacy and security.
Residents Association Objectives
  1. Provide for the maintenance, repair & replacement of Common Facilities & the development of additional facilities.
  2. Appoint the Design Control Committee & provide the mechanism & structure for the promulgation and enforcement of the Design Guidelines.
  3. Ensure the Private Way is maintained to Council's standards for engineering design and construction.
  4. Maintain the landscaping in and around the Private Way and other common facilities.
  5. To do all such things as may appear desirable to achieve the objects of the Association.
  6. Enforce compliance with the Rules of the Association.   

Roles & Responsibilities of the Committee

The Board of Directors is elected each year at the Annual General Meeting to manage the affairs of the Association pursuant to the Rules.
Role: Chairman
  • Chairing general & Board meetings
  • Countersigning payments to service providers and contractors as generated by the Treasure.
  • ​Ensuring compliance with the Rules of BVRA and that the binding agreements with Owners benefit all Owners for the use and enjoyment of Bella Vista Land,
  • Communicating with Owners who are in breach of the Rules or Covenants and ensuring that these are remedied,
  • ​Authorising the Long Term Maintenance Plan as submitted by the Board and approving the annual levy.
  • ​Counter-signing  contracts on behalf of BVRA as authorised by the Board.
Role: Design & Maintenance 
  • Chair the Design Control Committee that manages the approval of new structures and landscaping as well as modifications to existing properties,
  • Ensuring that any development work carried out on Bella Vista Land complies with the relevant District Plan, Design Guidelines, and Bylaws,
  • Publishing design guidelines from time to time,
  • Managing the maintenance of Common Facilities on behalf of the Board,
  • Creating Statements of Work for maintenance work to be performed ​on Common Facilities
  • Liaising with service providers and contractors in obtaining quotations and letting contracts for work  agreed  by the Board,
 Role: Secretary
  • Convening AGM  & other Association general meetings
  • Giving notices to owners as directed by the Board
  • Keeping minutes of Association and Board meetings
  • Countersigning  payments to service providers and contractors as generated by the Treasurer.
  • ​Giving all notices, certificates or information to the Registrar as required by the Act
  • ​Issuing & receiving correspondence on behalf of BVRA
  • Communicating with Auckland Council & advising Council of BVRA address.
  • Initial point of contact for issues and complaints


Role: Treasurer 
General financial oversight
  • Oversee and present budgets, accounts and financial statements to the management committee
  • Liaise with auditor (Jodi Wyatt)
  • Ensure that appropriate financial systems and controls are in place
  • Ensure that record-keeping and accounts meet the conditions of Incorporated Societies Act
  • Ensure compliance with relevant legislation (IRD)
  • Evaluate New Project Briefs for risk, financial viability, benefits to members, and funding sources
  • Take part in Gate Meetings for new projects and provide decision making on behalf of members
Funding, fundraising and billing
  • Determine strategy for fund management
  • Determine the source of funding for all payments being made
  • Determine annual levy due by members and obtain approval of committee
  • Issue levy invoices and manage collections from members.
  • Engage collection agency to recover levies when members don’t pay
  • Ensure effective monitoring and reporting of levy revenue
Financial planning and budgeting
  • Prepare and present budgets for new or ongoing work
  • Advise on financial implications of strategic and operational plans
  • Present revised financial forecasts based on actual spend
  • Prepare Project Plans for approved projects agreed by the Committee
Financial reporting
  • Present regular reports on the organisation’s financial position
  • Prepare accounts for audit and liaising with the auditor, as required
  • Publish accounts to Website annually
  • Present accounts and Treasurer’s Report at the AGM
  • Advise on the organisation’s reserves and investments
Banking, book-keeping and record-keeping
  • Manage bank accounts
  • Initiate all payments for accounts payable
  • Set up appropriate systems for book-keeping, payments, lodgements
Control of fixed assets
  • Ensure proper records are kept
  • Ensure asset risk insurances cover is maintained.
  • Advising on investment policy

Resident's House Rules

Bella Vista is a unique environment - these house rules have been created not only to retain this but also create a neighbourly atmosphere. These rules apply to owners, tenants and their guests.
Common Facilities are for the use and enjoyment of the whole Bella Vista community and should be used for the purpose for which they were designed.
Visitor car parking should be in a designated car space not on the Private Way.
Lots which have not been built on also warrant the same respect.
Parking in the common areas is for short term visitor parking not long-term occupant parking – this includes boats, trailers, caravans and camper vans.
Vehicles are to be driven in a responsible manner, keeping speed to a minimum for the safety of others.
Recycling and rubbish bins are to be put out no earlier than the day before and brought in by the next day of collection.
Keep your own property well maintained, attractive and compliant, with no accumulation of rubbish or unsightly materials or goods.
All rubbish & drying areas need to be screened.
Any dogs in the area should not be left to roam freely around the subdivision through other people’s property. Please ensure that all dogs are kept within your own property or on a lead !
If any resident observes common services not working or damage to those services it should be reported the BVRA secretary at [email protected]
Above all, respect the privacy and rights of all other residents to a quiet and peaceful time.

Rubbish & Recyclables

Rubbish and Recyclables Collection
There are three collections that take place to remove rubbish from Bella Vista:
Garbage
EconoWaste collect Wheelie Bins every Wednesday for those who have a prepaid account.  Their wheelie bins are friendly on the environment, mobile, clean, tidy and animal proof! Econowaste discourages the use of refuse wheelie bins for green waste and household recyclables.  These material must be diverted from landfill and use alternative recycling services.  Council Bylaws also restrict the placement of recoverable material in refuse bins in some areas. Waste Management also collect wheelie bins weekly on a Tuesday for those who have an account with them.

Recyclables
Auckland Council collect wheelie bins for recyclables every second Wednesday.
Items you can put in your recycling: Get the Guide here
  • Glass bottles and glass jars
  • Tin, steel and aluminium cans, including empty aerosols
  • Plastic bottles from your kitchen, bathroom and laundry (plastic grades 1-7)
  • Clear plastic food containers
  • Pizza boxes (remove any leftover food)
  • Newspapers, magazines, advertising mail and envelopes 
  • Paper and cardboard packaging  
  • Egg cartons  
  • Milk and juice cartons, including Tetra Pak ® cartons


Trailer Availability

​The Bella Vista trailer, situated in the trailer park, is used to move materials around the estate when required. When the amenity yard plantings need watering, an IBC tank is placed on the tray and water pumped from our storage tanks. One of the maintenance team will tow that to where the water is needed and irrigate those plants.  

The trailer is available for residents to use for transporting stuff. It is available by booking with Bryce Cameron on 021 906-711.

When you use the trailer the wheel clamp will need unlocking. Bryce has the key for that and will provide it for your use. It is important that when you return the trailer that you apply the wheel clamp and return the key to Bryce.
